Abstract
The central task of this Note is a search for explanations for the new state court activism. Part III is devoted to this search and will include discussion of criminal procedure as well as other civiil liberties cases. Part II will bring together the instances of state court activism beyond criminal procedure, the criminal procedure decisions haveing been surveyed adequately elsewhere.
