Barnett's article cited by U.S Court of Appeals for the Tenth Circuit
Abstract
Associate Professor Kent Barnett 's article "Resolving the ALJ Quandary" (66 Vanderbilt Law Review 797 (2013)) was cited by the U.S. Court of Appeals for the Tenth Circuit in the case Bandimere v. SEC. In its decision, the court held that SEC administrative law judges appointments were unconstitutional. The case is the first appellate decision to adopt this position, which Barnett advocated in his article.
