Barnett's article cited in federal judge's opinion
Abstract
Assistant Professor Kent Barnett's article "Resolving the ALJ Quandary" (66 Vand. L. Rev. 797, 812 (2013)) was cited in a decision by U.S. District Judge for the Northern District of Georgia Leigh Martin May (J.D.'98) in Hill v. SEC, in which the court preliminarily enjoined the SEC from engaging in administrative proceedings before an administrative law judge because the plaintiff was substantially likely to demonstrate that the ALJ's appointment violated the Constitution.
