Labor Provisions in U.S. Free Trade Agreements Under Trade Promotion Authority
Abstract
This chapter looks at labor provisions in U.S. free trade agreements entered into under the Bipartisan Trade Promotion Authority Act of 2002 and its amendments in 2007 and 2015. The chapter begins with an overview of statutory trade agreement negotiating objectives regarding labor and employment matters and continues with a discussion of the template for trade agreement labor chapters established in the 2002 agreements with Chile and Singapore. For each amendment to trade promotion authority, there is a summary of changes made to the template for treaties entered after that amendment, highlighting changes to the structure of the labor chapters, obligations between the parties, and dispute settlement procedures.
